Welcome to Linxme (lxme.app) - an online platform that allows users to create personalized pages with links, publish digital content, interact with audiences, integrate social media services, and access additional tools and features available on the platform.

The Service is owned and operated by Liubomyr Vus (the "Service Owner", "we", "us", or "our").

These Terms of Use ("Terms") govern your access to and use of the Service, including the website, mobile version, software, integrations, content management tools, analytics, monetization features, and any related functionality provided through the platform.

By accessing or using the Service, creating an account, publishing content, or interacting with the platform in any way, you confirm that you have read, understood, and agreed to these Terms, as well as the Privacy Policy and any additional policies referenced within the Service.

If you do not agree with these Terms, you must stop using the Service.

These Terms are governed by the legislation of Ukraine, including the Law of Ukraine "On Electronic Commerce," the Law of Ukraine "On Consumer Protection," the Law of Ukraine "On Information," the Law of Ukraine "On Copyright and Related Rights," and other applicable legal acts.

Eligibility and Account Registration

To access certain features of the Service, users may need to create an account. By registering, users confirm that the information they provide is accurate, current, and complete.

Users must be legally capable of accepting these Terms under applicable law. If a user creates an account on behalf of a business, brand, organization, or another individual, they confirm that they are authorized to act on behalf of that entity.

Users are responsible for maintaining the confidentiality of their login credentials and for all activities that occur under their account. The Service Owner recommends using strong passwords and taking reasonable measures to secure account access.

Accounts may not be transferred, sold, shared, or used in a manner that violates these Terms, applicable law, the rights of third parties, or the integrity and security of the platform.

The use of bots, scripts, automated registration systems, scraping tools, or other automated methods to create accounts or interact with the platform in an unauthorized manner is prohibited.

Usernames and Public Identity

When creating an account, users may choose a username or profile identifier. Usernames must not infringe intellectual property rights, impersonate another person or organization, mislead other users, or violate applicable law.

The Service Owner reserves the right to request modification of a username, restrict its use, or reassign it where necessary to protect the rights of third parties, prevent abuse, resolve disputes, or maintain platform integrity.

Inactive usernames associated with accounts that remain unused for an extended period may be reclaimed or reassigned at the discretion of the Service Owner.

Subscription Plans and Paid Features

The Service may offer free and paid subscription plans, premium features, trial periods, promotional offers, or additional functionality available through recurring payments or one-time purchases.

By subscribing to a paid plan, users authorize the Service to charge the selected payment method for applicable subscription fees and taxes according to the selected billing cycle.

Unless canceled before the renewal date, paid subscriptions may automatically renew for subsequent billing periods.

Users may cancel subscriptions at any time through their account settings or through the payment platform used for the original purchase. Cancellation will usually take effect at the end of the current billing period unless otherwise required by law.

Refunds are governed by our Refund Policy, available at lxme.app/refunds, which includes a 14-day money-back guarantee on first purchases. Subscription renewal payments are generally non-refundable, though the Service Owner may consider refund requests in exceptional circumstances.

If subscriptions are purchased through third-party platforms such as Apple App Store or Google Play, refunds and cancellation procedures are subject to the policies of those platforms.

User Content

The Service allows users to publish, upload, display, distribute, and share content including text, links, graphics, images, videos, digital products, messages, profile descriptions, and other materials ("User Content").

Users retain ownership of their content. However, by publishing content through the platform, users grant the Service Owner a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, adapt, distribute, and technically process such content for the purpose of operating, improving, promoting, and maintaining the Service.

Users confirm that:

• they own the content they publish or possess the necessary rights and permissions to use it;
• the content does not violate Ukrainian law or third-party rights;
• the content is not fraudulent, misleading, harmful, defamatory, or illegal;
• the content does not contain malicious software or harmful code;
• the content complies with platform rules and community standards.

Users remain solely responsible for their content and for any consequences related to its publication or distribution.

Public Profiles and Visibility

The Service is designed to allow users to create public-facing pages accessible through the Internet. Information voluntarily published through profiles may become publicly available and accessible to visitors, search engines, and third-party services.

Users independently decide what information to publish and acknowledge the risks associated with publicly sharing information online.

The Service Owner is not responsible for how third parties may copy, archive, distribute, reproduce, or otherwise use publicly available information.

Prohibited Activities

Users may not use the Service to:

• violate Ukrainian or international law;
• infringe intellectual property rights;
• distribute malware, spam, or phishing materials;
• engage in fraud or deceptive practices;
• harass, threaten, exploit, or harm others;
• distribute hateful, discriminatory, extremist, or violent content;
• collect data from other users without authorization;
• interfere with platform operation or security;
• bypass technical limitations or access restrictions.

The following are strictly prohibited and constitute grounds for immediate account termination:

• Publishing, linking to, or promoting any content that sexually exploits or depicts minors (CSAM) in any form. This includes links, images, videos, or descriptions. Violations will be reported to law enforcement and relevant authorities without exception.
• Publishing, linking to, or promoting adult content, including pornography, sexually explicit materials, escort or adult webcam services, or any other content of a sexual nature. This applies to profile content, images, descriptions, and destination websites of any links added to the Service.
• Adding links to websites that distribute illegal content of any kind, including but not limited to pirated software, copyrighted materials without authorization, controlled substances, weapons, counterfeit goods, or services that violate applicable law.
• Adding links to websites that engage in fraud, phishing, identity theft, or financial scams.
• Adding links to malware, ransomware, spyware, or any software designed to harm users or their devices.
• Impersonating another person, brand, or organization through profile information, usernames, or links.
• Using the Service to promote or facilitate human trafficking, exploitation, or any form of abuse.

The Service Owner reserves the right to determine, at its reasonable discretion, whether specific conduct violates these Terms or creates risks for the platform or its users.

Moderation and Enforcement

To maintain a safe and functional environment, the Service Owner may monitor platform activity and take actions including restricting content visibility, removing materials, limiting functionality, suspending accounts, or permanently terminating access to the Service.

Such actions may be taken where the Service Owner reasonably believes that:

• a violation of these Terms occurred;
• unlawful activity may be taking place;
• the platform or users may be exposed to security, reputational, or legal risks;
• compliance with legal obligations requires such action.

The Service Owner reserves the right to suspend or permanently terminate any account at any time, without prior notice and without liability, for any reason, including but not limited to violation of these Terms, suspicious activity, harm to other users, or risk to the integrity of the platform. Users whose accounts are terminated for violations of these Terms forfeit any right to appeal, refund, or data recovery.

Where reasonably possible, users may be notified regarding enforcement actions. However, the Service Owner is not obligated to provide prior notice and may act immediately where urgent circumstances require it, including cases involving illegal content, security threats, or violations that put other users at risk.

Monetization and Transactions

The Service may allow users to monetize content, receive payments, sell digital products, promote affiliate links, receive donations, or interact with third-party payment systems.

Users remain solely responsible for:

• complying with tax obligations;
• complying with consumer protection laws;
• fulfilling obligations toward customers;
• refund handling;
• product delivery;
• financial reporting;
• compliance with advertising disclosure rules.

The Service Owner is not considered the seller of record for transactions conducted directly between users and third parties unless explicitly stated otherwise.

Payment processing may be provided through third-party providers. The use of such services may be subject to additional terms and policies imposed by those providers.

Intellectual Property

All rights, title, and interest in and to the platform itself — including but not limited to the source code, software architecture, design, user interface, graphics, logos, the "Linxme" name and brand, trademarks, trade dress, databases, documentation, and all platform functionality — are and shall remain the exclusive property of the Service Owner, Liubomyr Vus, or relevant licensors.

License, Not Ownership. Subject to compliance with these Terms, the Service Owner grants users a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for its intended purpose. This license does not grant users any ownership rights in the Service, its software, brand, or any other intellectual property of the Service Owner. The license terminates automatically upon account deletion, termination, or violation of these Terms.

Except where explicitly permitted, users may not copy, modify, distribute, reverse engineer, decompile, reproduce, scrape, sell, license, or commercially exploit any part of the Service.

Nothing in these Terms transfers ownership of platform intellectual property to users. Any feedback, suggestions, or ideas submitted by users regarding the Service may be used by the Service Owner without restriction or compensation.

Third-Party Services and Integrations

The Service may contain integrations, embedded content, external links, APIs, or functionality provided by third-party services including social networks, payment systems, analytics providers, cloud infrastructure providers, and advertising platforms.

The Service Owner does not control and is not responsible for:

• third-party content;
• external services;
• third-party privacy practices;
• external payment systems;
• availability or functionality of third-party platforms.

Use of third-party services may be subject to separate terms and privacy policies that users are responsible for reviewing independently.

Availability of the Service

The Service is provided on an "as is" and "as available" basis.

While we strive to maintain stable platform operation, we do not guarantee uninterrupted availability, error-free performance, compatibility with all devices, or continuous access to any specific feature.

The Service Owner may modify, suspend, discontinue, or update any part of the platform at any time without liability.

Limitation of Liability

To the maximum extent permitted under applicable law, the Service Owner shall not be liable for indirect, incidental, consequential, punitive, or special damages, including loss of profits, business interruption, loss of reputation, loss of data, or losses resulting from:

• use of the platform;
• third-party actions;
• unauthorized access;
• platform interruptions;
• user-generated content;
• technical failures;
• external integrations or payment providers.

Users are responsible for maintaining backups of their content and securing their own devices and accounts.

Where liability cannot be excluded under applicable law, the total liability of the Service Owner shall not exceed the amount actually paid by the user to the Service during the preceding 12 months.

Privacy and Personal Data

The processing of personal data is governed by the Privacy Policy, which forms an integral part of these Terms.

By using the Service, users acknowledge that personal data may be processed in accordance with the Privacy Policy and applicable Ukrainian legislation. The Privacy Policy also explains users' rights regarding access, correction, deletion, and protection of personal information.

Suspension and Termination

Users may stop using the Service and delete their account at any time.

The Service Owner reserves the right to suspend, restrict, or terminate access to the platform without prior notice where necessary to:

• enforce these Terms;
• comply with legal obligations;
• protect the platform or its users;
• investigate suspicious activity;
• prevent abuse or security threats.

Termination of access may result in deletion of content, profile information, analytics, or platform functionality.

Changes to the Terms

The Service may update these Terms from time to time due to changes in legislation, platform functionality, technical requirements, business operations, or security considerations.

Updated versions will be published on the website. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

Governing Law and Dispute Resolution

These Terms shall be governed by and interpreted in accordance with the laws of Ukraine.

Any disputes related to the Service, the platform, user content, or these Terms shall be resolved through negotiations where possible. If a dispute cannot be resolved amicably, it shall be subject to the jurisdiction of the courts of Ukraine in accordance with applicable law.
